          \nb- Je\u015bli nie uzgodniono inaczej, wszytkie produkty powinny by\u0107 op\u0142acone w terminie 30 dni i bez upust\u00f3w.
          \nc- W przypadku pierwszej transakcji, p\u0142atno\u015b\u0107 powinna by\u0107 dokonana got\u00f3wk\u0105 lub przedp\u0142at\u0105 i bez \u017cadnych upust\u00f3w.

            \n– Gwarancja jest wa\u017cna jedynie w przypadku gdy serwis techniczny Firmy powiadomi po analizie uszkodzonego produktu lub jego cz\u0119\u015bci, \u017ce dane uszkodzenie nie powsta\u0142o w zwi\u0105zku z zaniedbaniem lub modyfikacj\u0105 cech produktu dokonan\u0105 przez strony klienta.
            \n– Chambrelan w \u017cadnym wypadku nie jest odpowiedzialne w stosunku do Klienta ani \u017cadnej innej osoby za \u017cadne straty lub uszkodzenia wynikaj\u0105ce bezpo\u015brednio lub po\u015brednio z u\u017cycia produkt\u00f3w ani te\u017c \u017cadnych handlowych konsekwencji, jakie mog\u0105 by\u0107 wynikiem strat lub uszkodze\u0144.               a- Klient jest w pe\u0142ni odpowiedzialny za instalacj\u0119 oraz serwisowanie produkt\u00f3w przez wyspecjalizowany personel kt\u00f3ry b\u0119dzie dzia\u0142a\u0142 zgodnie z instrukcjami oraz szerzej m\u00f3wi\u0105c zgodnie z odpowiednimi, najlepszymi praktykami w tym zakresie. Klient jest w pe\u0142ni odpowiedzialny za produkty jakie s\u0105 przedmiotem przeprowadzanej przez niego instalacji, pracy lub serwisu. W szczeg\u00f3lno\u015bci, Klient powiniem uzyska\u0107 wszelkie wymagane uprawnienia, licencje lub certyfikaty wymagane do przeprowadzania instalacji, u\u017cytkowania czy powierzania produkt\u00f3w.
              \nb- Chambrelan nie akceptuje \u017cadnych zobowi\u0105za\u0144 dotycz\u0105cych istalacji i serwisowania produkt\u00f3w.
              \nc- Klient nie jest odpowiedzialny wzgl\u0119dem Chambrelan za wszelkie uszkodzenia wynikaj\u0105ce z wadliwego monta\u017cu lub instalacji produkt\u00f3w.<\/p>\n

              1. W\u0142a\u015bno\u015b\u0107 intelektualna, patenty<\/strong><\/li>\n<\/ol>\n

                Chambrelan zastrzega sobie prawo do interwencji s\u0105dowej lub innej w przypadku jakiegokolwiek dzia\u0142ania dokonanego przez kt\u00f3regokolwiek ze swoich klient\u00f3w w przypadku naruszenia lub wykorzystania patent\u00f3w, zasad projektowych, proces\u00f3w produkcyjnych czy znak\u00f3w handlowych nale\u017c\u0105cych do Firmy. Wspomniany klient, pod gro\u017ab\u0105 obowi\u0105zkowego odszkodowania, zwi\u0105zanego z zabezpieczeniem w zakresie interwencji.
                \nOprzyrz\u0105dowanie, plany, analizy dokonane przez Chambrelan w zakresie produkcji specjalnych element\u00f3w pozostaj\u0105 w\u0142asno\u015bci\u0105 Chambrelan nawet je\u015bli adekwatny wk\u0142ad w koszty analiz czy oprzyrz\u0105dowania by\u0142 wymagany ze strony klienta.<\/p>\n

                1. Zabezpiecznie w\u0142asno\u015bci<\/strong><\/li>\n<\/ol>\n

                  W\u0142asno\u015b\u0107 sprzedanych produkt\u00f3w nie jest przeniesiona na klienta do momentu dokonania pe\u0142nej p\u0142atno\u015bci za te produkty. Niezale\u017cnie, ryzyko uszkodze\u0144, straty lub kradzie\u017cy produkt\u00f3w jest przeniesione na kupuj\u0105cego natychmiast po dostawie. Kupuj\u0105cy musi w zwi\u0105zku z powy\u017cszym zapewni\u0107 wymagane ubezpiecznie w celu pokrycia tego ryzyka.<\/p>\n

                  1. Si\u0142y wy\u017csze<\/strong><\/li>\n<\/ol>\n

                    Chambrelan jest zwolniony od wszelkich zobowi\u0105za\u0144 w przypadku przypadkowych zdarze\u0144 nieoczekiwanych zwanych si\u0142ami wy\u017cszymi. Jako takie s\u0105 traktowanie m.in. nast\u0119puj\u0105ce zdarzenia: strajki i blokady wp\u0142ywaj\u0105ce na dzia\u0142ania Chambrelan lub jego dostawc\u00f3w. Klient nie b\u0119dzie wykorzystywa\u0142 takich zdarze\u0144 w celu anulacji zam\u00f3wienia. Ilo\u015b\u0107 produkt\u00f3w jaka jest gotowa do dostawy w momencie wyst\u0105pienia wskazanych zdarze\u0144 musi zosta\u0107 zaakceptowana przez klienta oraz op\u0142acona.<\/p>\n

                      \n
                    1. Postanowienia oglne, prawodawstwo<\/strong><\/li>\n<\/ol>\n

                      W przypadku wyst\u0105pienia sporu, miejscem jego rozstrzygania b\u0119dzie wy\u0142\u0105cznie s\u0105d odpowiedni wzgl\u0119dem lokalizacji siedziby Chambrelan, nawet w przypadku reklamacji gwarancyjnej.<\/p>\n

                      General Terms and Conditions of Sale<\/h2>\n

                      1\/ GENERAL<\/strong>
                      \na) The sales of the company CHAMBRELAN are made exclusively to the present general conditions of sale.
                      \nb) Any deviation from these conditions must have been expressly accepted and mentioned in writing on the acknowledgement of receipt of the order.
                      \nc) The information contained in the Company’s catalogues, prospectuses and tariffs, as well as the declarations of the Company’s sales representatives and technicians, are for information purposes only.
                      \nd) Any firm order accepted by our Company implies, for the buyer, the unconditional acceptance of these general conditions of sale which cancel all clauses and stipulations printed on the orders or on the correspondence of the buyers.
                      \ne) Unless expressly agreed otherwise in writing,
                      \n– CHAMBRELAN does not accept any order cancellation for any reason whatsoever.
                      \n– CHAMBRELAN does not take back its sold goods.<\/p>\n

                      2\/ DELIVERY<\/strong>
                      \na) The delivery times relating to the acceptance of the order, as well as those mentioned in the offer, are only indicative and any delays do not entitle the customer to cancel the sale, refuse the goods or claim damages.
                      \nb) CHAMBRELAN does not accept in any way any penalties for delay.
                      \nc) Claims must be duly written on the proof of delivery. Otherwise we will not be able to intervene.<\/p>\n

                      3\/ PRICE<\/strong>
                      \na) Prices are invoiced in accordance with the rate in effect on the day of delivery. They may be modified in the event of regulatory changes or significant changes in transport costs.
                      \nb) Unless otherwise agreed in writing, the CHAMBRELAN prices are always exclusive of tax, departure from CHAMBRELAN stores and carriage and packaging at the buyer’s expense.
                      \nc) For any order, a minimum chargeable of 100\u20ac HT per delivery will be applied.
                      \nd) For all products manufactured to drawing, a minimum amount per delivery of \u20ac300 excl. tax will be applied.
                      \ne) Any certificates requested will be invoiced in addition, for each delivery rate.
                      \nf) Administration costs may be applied.<\/p>\n

                      4\/ PAYMENTS<\/strong>
                      \na) The place of payment is CHAMBRELAN Le Havre regardless of the method of payment. Bills of exchange, bills of exchange, free shipping, etc., do not provide any derogation from the place of payment.
                      \nb) Unless otherwise agreed by us, all our goods are payable at 30 days end of month on the 15th net and without discount, from the date of invoice.
                      \nc) In the case of a first case, payment is made by cheque with the order net and without discount.
                      \nd) In accordance with the provisions of Article L441.6 of the French Commercial Code, any delay in payment will automatically give rise, in addition to late payment penalties set at five times the legal interest rate, to additional invoicing for collection costs. This will be calculated on the basis of the actual costs incurred (postage, lawyer, etc.) plus a flat-rate fee of at least 150 euros.

                      5\/ RECEPTION, GUARANTEE<\/strong>
                      \na) In the absence of having notified the CHAMBRELAN Company, before installing the said goods, of any relative reserves other than those resulting from the transport, the customer shall be presumed to have waived all claims and shall not be entitled to claim any apparent defects and defects of the goods.
                      \n(b) In general, the operation of the guarantee will be governed by the following rules:
                      \n– The warranty granted by CHAMBRELAN is strictly limited to the supply or replacement of defective goods.
                      \n– As this is a wear part whose service life is determined by the correct assembly and use of the product, CHAMBRELAN does not guarantee any service life for its products.
                      \n– The warranty only applies to the normal use of our Company’s equipment in accordance with its instructions.
                      \n– The warranty will only apply in cases where our Company’s technical services acknowledge after examination of the defective part that the defect is not due to negligence or modification attributable to the buyer.
                      \n– CHAMBRELAN shall in no event be liable to the buyer or any other person for any loss or damage resulting directly or indirectly from the use of the goods, or for any commercial prejudice that may result therefrom. CHAMBRELAN therefore does not accept any charges whatsoever in the event of a defect.
                      \n– CHAMBRELAN does not accept any administrative charges for any reason whatsoever.<\/p>\n

                      6\/ INSTALLATION, MAINTENANCE<\/strong>
                      \na) The customer shall be fully responsible for the installation and maintenance of the equipment by specialized personnel who shall comply with the manual and, more generally, with the best practices in this field. The customer will be fully responsible for the equipment for which he\/she is responsible for installation, operation and maintenance. In particular, he must obtain all authorizations, licences and certificates necessary for the installation, use and disposal of the equipment.
                      \nb) CHAMBRELAN does not assume any obligation regarding the installation and maintenance of the equipment.
                      \nc) The customer is not liable to CHAMBRELAN for any damage resulting from the defective assembly or installation of the goods.<\/p>\n

                      7\/ INTELLECTUAL PROPERTY, PATENTS<\/strong>
                      \na) CHAMBRELAN reserves the right to intervene in court or otherwise in any action brought against any of its customers based on an infringement of a patent, design, process or trademark belonging to it, the said customer must, under penalty of mandatory damages, call CHAMBRELAN as collateral.
                      \nb) The tools, plans, studies that CHAMBRELAN may create for the production of special parts remain the property of CHAMBRELAN even if a contribution to the costs of studies or tools has been requested from the customer.<\/p>\n

                      8\/ RESERVATION OF OWNERSHIP<\/strong>
                      \na) Ownership of the goods sold shall not be transferred until full payment of the price has been made. However, the risk of damage, loss or theft of the goods shall be transferred to the buyer upon delivery. The buyer will therefore have to take out all the necessary insurance to cover these risks.<\/p>\n

                      9\/ FORTUITOUS CASES OF FORCE MAJEURE<\/strong>
                      \na) CHAMBRELAN is released from its obligations for any fortuitous event or force majeure. The following events are considered as such: strikes and lockouts affecting CHAMBRELAN or its suppliers. The customer will not be able to invoke such events to cancel his order. The quantities ready for delivery at the time of the event must be accepted by the customer and paid for.<\/p>\n

                      10\/ GENERAL PROVISIONS, JURISDICTION<\/strong>
                      \na) In the event of a dispute, the court at the registered office of CHAMBRELAN shall have sole jurisdiction, even in the event of a warranty claim.<\/p>\n
